I just found in the documentation XGBoost Parameters — xgboost 1.7.6 documentation under the point for max_depth.
The interval is specified as [0,inf] but as far as I know, infinity is not a real number, and thus the interval should be open on the right.
This is probably negligible, but if you want I can file an issue/pr on GitHub and edit it
